Recently, the Beijing Municipal Commission of Housing and Urban-Rural Development released the Management Methods for Transfer of Property Projects of Beijing Municipality (Exposure Draft) to collect opinions and suggestions from the society. Release of the Management Methods plays an active role in standardizing the transferring activities of property projects, protecting legal rights and interests of property owners, construction units and property service enterprises, and promoting healthy development of property management industry.
The Management Methods for Transfer of Property Projects of Beijing Municipality (Exposure Draft) is an important auxiliary to Property Management Methods of Beijing Municipality, and specifies detailed rules for implementing the principle regulations on the transfer of property projects as specified in the Property Management Methods.
The Management Methods for Transfer of Property Projects was revised and improved based on the practices of the Guiding Opinion of Beijing Municipal Commission of Housing and Urban-Rural Development on Issues Related to Transfer of Residential Housing Property Projects (Jing Jian Wu [2006] No. 23). The Management Methods aims at solving the main issues in the transfer of property projects focusing on transferring types and contents of property projects, procedures, behaviors and emergency-response property services. The Management Methods specifies the rights, obligations and responsibilities of property owners, construction units and property service enterprises in the transferring process. It further provides directions for transfer of property projects to carry out related activities in accordance with the laws.
Specifying types and contents for transfer of property projects
Based on different subjects, there are two types of transfer property projects: transfer between construction units and property owner, and transfer between property service enterprise and property owner. The contents include inspection and transfer of common parts of property and the transfer of property management.
Specifying property projects transfer procedures and standardizing transfer behaviors
The Management Methods has specific details on transfer procedures for different types of transference, clarification of respective rights, obligations and responsibilities of property owners, construction units, and service enterprises. For property service enterprises who fail their transfer obligations, refuse to withdraw from property management regions, and compulsively take over the projects, the administrative regulatory departments of houses will deal with the property service enterprises and related responsible persons in accordance with regulations on the credit information management and property service project management of property service enterprises.
Specifying contents related to emergency-response property services.
It is stated that the sub-district, town or township organizations shall manage to provide emergency response services on the property in order to ensure the basic living order of property owners in case of emergency, i.e. there is no manager in a community which makes it more difficult to maintain the organized property management order.
